ATC doesn't generally recommend enforcement. They just write up events and they get submitted. It is up to the enforcement folks at the FSDO and above to decide what to do. True, but I did think the controllers have some discretion as to what gets reported to the FSDO within limits, such as a loss of separation being a mandatory report. But glad to hear it was sent on to the FSDO. Although I am very familiar with the Compliance program where most deviations are dealt with by remedial training, I would have really thought that if an inspector has good cause to determine a deviation was beyond remedial training, this had to be a good example of one because of the pilots Anti-Authority hazardous attitude clearly portrayed on the tape recording. However, we may not know all the details of what happened between Inspector and Pilot.

They do have some discretion if it's not a mandatory report item. I try not to have opinions about what anyone else, let alone what the FAA "should" do without knowing all the details (I sometimes fail :D). Yes, from the recordings, it does sound like someone who is seriously anti-authority, but without knowing what happened afterward, I don't know what I would do if I were king.
