It is up to the enforcement folks at the FSDO and above to decide what to do. I haven't the vaguest clue what happened here, but most deviations these are handled via the Compliance Program with no violation record. True, but I did think the controllers have some discretion as to what gets reported to the FSDO within limits, such as a loss of separation being a mandatory report. But glad to hear it was sent on to the FSDO. Although I am very familiar with the Compliance program where most deviations are dealt with by remedial training, I would have really thought that if an inspector has good cause to determine a deviation was beyond remedial training, this had to be a good example of one because of the pilots Anti-Authority hazardous attitude clearly portrayed on the tape recording. However, we may not know all the details of what happened between Inspector and Pilot. 1 Quote

I try not to have opinions about what anyone else, let alone what the FAA "should" do without knowing all the details (I sometimes fail :D). Yes, from the recordings, it does sound like someone who is seriously anti-authority, but without knowing what happened afterward, I don't know what I would do if I were king. Quote
