isaacpr7 Posted November 23, 2013 Author Report Posted November 23, 2013 Ok.... Say you are willing to take the risk that you are right..... You file and take the deduction. (1) you are right and everything goes away as planned. (2) you are wrong, they let you know, and you have to pay what you owe + a percentage for their effort. I'm not a tax expert, but I have been audited...., remember to get the payments and IRAs in on time!!! Like Mooney training, It helps to hire a professional when you live on the edge. I was young once, -a- I never said I was willing to take the risk. It is exactly why I started this post, hoping someone with proper qualifications (i.e. tax lawyers or CPAs) would take any doubts in my mind that doing so would be legal. I have read every post with references in black and white carefuly and respect everyones opinion on the subject; however, I only intend to do what's right and feels honest to me. Quote
isaacpr7 Posted November 23, 2013 Author Report Posted November 23, 2013 And this from an Air Force guy sitting in air-conditioning while the Army provided us with some of the best food and lodging ever! The best food and lodging ever? Are you sure you are refering to the US Army? LOL! For the record, I do think food is getting better down range compared to the six months of MRE's on my first deployment to Iraq Okay, now back to taxes before we stray from the topic too much Quote
isaacpr7 Posted November 23, 2013 Author Report Posted November 23, 2013 The link I posted on the 1st page contains a article written by a CPA specializing in aviation matters. He mentions supporting case law in a couple of his statements. You may want to see if you can get copies of the cases and see how similiar they are to your situation. He doesn't go into detail, but on the surface they seem very similiar to what you are asking about. I will surely do that. This is starting to feel like a college research paper but it is worth the knowledge. Maybe I could shed some light to others in the future on this matter Quote
Danb Posted November 23, 2013 Report Posted November 23, 2013 I was not goin to chime in again but there tax situation that have gone though audit for the military that fits this case in that it is a deductable expense, irs reg. are the next support after the code there this available, there have been cases .As long as you have factual justification for the deduction which there are then you have reason to present in which you have relied on. There is a great tax firm in Fla specialist in avaition and one in Indiana which you could contact for your supporting doc. Otherwise you can research and get the background to support the deduction, the regs, state items needed etc are deductible You can also get an opinion on your specific situation but this had been done...lawyers usually do there homework prior to answering questions unfortun. Some on this forum has not. 1 Quote

Danb Posted November 23, 2013 Report Posted November 23, 2013 I can not give professional advice per my ee contract, which is why I have been vague, start with code sec 162'. Then regs 1.162-5 a 1' b 3. Torres vs tc 1981. Freeze vs tc 1963. Rev ruling 69-199. Expense publications 529, 552, 501, 583, also as far as advice from a bravo Gx driver from openskyflyer we do and have provided service to military at no charge. I guess this helps pay for my bravo..this thread shows that everyone knows about tax law and provides advice hopefully when you all need a heart spec. You would listen to those truly in the profession. That's all folks 1 Quote

Namely, "Let Your Conscience Be Your Guide." 1 Quote
